Welcome to DARTO Europe! The terms "we", "us" and "our" refer to DIBDE GmbH, operating under the trade name DARTO Europe. DIBDE GmbH operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). The website is powered by Shopify.
The following terms and conditions, together with all policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and obligations when using the Services.
Please read these Terms carefully, as they contain important information about your legal rights. By visiting or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use our Services.
Section 1 – Access and Account
By agreeing to these Terms of Service, you confirm that you are of legal age in your state or province of residence, and that you have given us your consent to allow any minor dependents to use the Services on devices you own, purchase or manage.
To use the Services you may be asked to provide certain information, such as your email address, billing, payment and shipping details. You confirm that all information you provide is accurate, current and complete.
You are solely responsible for the security of your login credentials and for all activity in your account. You may not transfer, sell, assign or license your account to any third party.
Section 2 – Our Products
We have made every effort to display our products accurately in our online store. Please note, however, that colors or the appearance of products may differ from what is shown on your screen, depending on the device you use and its settings and configuration.
All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities on a case-by-case basis.
Section 3 – Orders
When you place an order, you are making a purchase offer. DIBDE GmbH reserves the right to accept or decline your order at its sole discretion. Your order is only accepted once we confirm acceptance.
Please review your order carefully before submitting it. Cancellation requests after order acceptance can generally no longer be accommodated, with the exception of orders placed as part of our pre-sale: these may be cancelled free of charge until you receive the shipping confirmation email.
Returns and exchanges are governed by our Right of Withdrawal and our Return and Refund Policy.
You confirm that your purchases are intended for personal use and not for commercial resale or export.
Section 4 – Prices and Billing
All prices displayed on our website are final prices in euros and include the applicable statutory VAT. Shipping costs are not included in the displayed product price and will be shown separately during checkout before you complete your order.
Discounts and promotions may be changed without prior notice. The price charged for a product is the price in effect at the time of ordering and will be stated in your order confirmation. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion shall prevail.
You agree to provide current, complete and accurate payment and account information for all purchases and to update this information promptly when it changes.
Section 5 – Shipping and Delivery
All delivery times are estimates and are not guaranteed. We accept no responsibility for delays caused by shipping carriers, customs clearance or events beyond our control. In accordance with § 474 of the German Civil Code (BGB), the risk of loss passes to you as a consumer only upon actual delivery of the goods. Section 6 – Intellectual Property
Our Services, including all trademarks, texts, images, graphics, videos and audio files, as well as their design, selection and arrangement, are the property of DIBDE GmbH, its affiliates or licensors and are protected by European and international copyright, trademark and other intellectual property law.
These Terms permit you to use the Services solely for your personal, non-commercial use. Without our prior written consent, you may not reproduce, distribute, modify or create derivative works from any materials on the Services.
Section 7 – Optional Tools
You may be given access through the Services to tools provided by third parties. We do not monitor these tools and have no control over them. Use of such tools is entirely at your own risk. We accept no liability for any damages arising from the use of optional third-party tools.
Section 8 – External Links
The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of such websites. If you leave the Services to access external websites, you do so at your own risk.
Section 9 – Relationship with Shopify
DIBDE GmbH is powered by Shopify, which enables us to provide you with the Services. However, all sales and purchases you make in our store are made directly with DIBDE GmbH. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and DIBDE GmbH, including any injuries, damages or losses arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or in connection with your purchases and transactions with DIBDE GmbH.
Section 10 – Privacy Policy
All personal data we collect through the Services is subject to our Privacy Policy. By using the Services, you confirm that you have read it. Section 11 – Feedback
When you submit feedback, reviews or other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify and distribute such content for any purpose, including commercial purposes. You confirm that you hold all necessary rights to the content you submit and that it does not infringe any third-party rights.
Section 12 – Errors, Inaccuracies and Omissions
Information on our website may occasionally contain typographical errors, inaccuracies or omissions. We reserve the right to correct any errors at any time without prior notice and to cancel orders where information is inaccurate.
Section 13 – Prohibited Uses
You may only use the Services for lawful purposes. Prohibited uses include, in particular: use for unlawful or malicious purposes; infringement of intellectual property rights; submission of false or misleading information; sending spam or unsolicited messages; and interfering with the security features of the Services. We reserve the right to suspend your account at any time and without notice if we determine that you have violated these Terms.
Section 14 – Agents
14.1 This section applies when you use, permit, enable or cause an agent to access or interact with the Services. "Agent" means any software or service that acts autonomously or semi-autonomously on behalf of a person.
14.2 No agent may access the Services unless it identifies itself at all times and acts in strict compliance with the requirements in Section 14.4.
14.3 We may restrict, including through technical means, whether and how an agent accesses the Services.
14.4 Agents must indicate in all HTTP/HTTPS requests that the request originates from an agent; must not conceal that access originates from an agent; must respond truthfully to questions intended to determine whether interactions originate from a human or a computer; and must not circumvent any measures intended to restrict agent access.
Section 15 – Termination
We may terminate this agreement or your access to the Services at any time and without notice. The sections on Intellectual Property, Feedback, Liability, Indemnification and Governing Law shall survive termination.
Section 16 – Statutory Warranty
The statutory warranty for defects applies to our products in accordance with the provisions of the German Civil Code (BGB). As a consumer, you are entitled to the following statutory rights in the event of defective products: subsequent performance (repair or replacement), reduction of the purchase price, or withdrawal from the contract. The limitation period for warranty claims is two years from delivery of the goods. These statutory rights exist independently of any voluntary guarantees.
Section 17 – Limitation of Liability
We are fully liable for damages arising from injury to life, body or health, as well as for damages caused by intent or gross negligence on the part of DIBDE GmbH, our legal representatives or agents. In cases of slight negligence involving a breach of material contractual obligations, our liability is limited to the typically foreseeable damage. Any further liability for slight negligence is excluded. Mandatory statutory liability provisions, in particular under the German Product Liability Act (Produkthaftungsgesetz), remain unaffected.
Section 18 – Indemnification
You agree to indemnify and hold harmless DIBDE GmbH, Shopify and our affiliates, officers, directors, employees and agents from all losses, damages and claims arising from (1) your breach of these Terms, (2) your violation of applicable law or third-party rights, or (3) your access to and use of the Services.
Section 19 – Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severed from the remaining Terms. The validity of the remaining provisions shall not be affected.
Section 20 – Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right. These Terms, together with all published policies, constitute the entire agreement between you and us.
Section 21 – Assignment
Without our prior written consent, you may not assign or transfer this agreement or your rights and obligations under these Terms. We may assign or transfer these Terms without your consent.
Section 22 – Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes with merchants or legal entities under public law is Hamburg. Notwithstanding the foregoing, you as a consumer retain the protection afforded to you by the mandatory provisions of the law of your country of residence (Article 6 of the Rome I Regulation).

The headings used in this agreement are included for convenience only and shall not limit or otherwise affect these Terms.
Section 24 – Changes to Terms of Service
The most current version of these Terms is available on this page at any time. We reserve the right to update these Terms at any time. We will inform you of any material changes in accordance with applicable law. By continuing to use the Services after changes are published, you agree to the updated Terms.
